The Will of Mr John Featherston Dated August 18. 1847 Died 26th November 1848
This is the last will and testament of me John Featherston of the Borough and County of Newcastle upon Tyne grocer. I give and bequeath all estates vested in me as trustee or mortgagee unto James Sillick of Newcastle upon Tyne currier and James Arnott of the borough of Gateshead gentleman their heirs executors administrators and assigns Subject to the trusts and equities affecting the same. I give and bequeath all my household furniture beds, bedding, plate, linen, china, glass books, prints, pictures, wines, spirits and all other my household effects of which I shall die possessed unto my dear wife Ann Featherston absolutely. I give devise and bequeath all my other estate and effects whatsoever as well real as personal unto the said James Sillick and James Arnott and the survivor of them and the heirs executors administrators and assigns of such survivor upon trusts and for the purposes hereinafter declared and expressed concerning the same that is to say. Upon trust to permit my said wife to carry on so long as she shall think proper the business in which I shall be engaged at my death and for that purpose to employ such part of my estate as she shall think fit and shall at any time at her request transfer the business to any son or sons of mine or admit him or them to a share thereof and shall at her request lend to him or them the capital employed or requisite to be employed therein or any part thereof upon such personal or other security and such terms as she shall think reasonable. And from and after the decease of my said wife my trustees or trustee shall have power to carry on my business for such period as the circumstances of my estate or my family shall in their or his opinion render it convenient or desirable so to do and for that purpose to employ such part of my estate as they shall think fit with liberty to exercise at their or his discretion all the powers which I have hereinbefore directed them to exercise at the request of my said wife and subject to the powers and provisions hereinbefore contained. I direct that my said trustees or trustee shall at the discretion of my said wife either permit my estate to continue in the state in which it shall be found at my death or sell get in and convert the same or any part thereof and shall invest the proceeds upon such stocks funds or securities or in the purchase of such real or personal property as she shall direct and shall vary such investments when and as she shall think fit and that until such sale of my real estate the same and any real property so purchased shall be convertible into and treated as personally for all the purposes of my will. And from and after the death of my said wife the trustee or trustees shall have power if they think fit at any time to sell such part of my property as may consist of real estate and shall convert or get in my personal estate not invested in Government or real securities but with liberty to continue any investments of a different description which they or he shall think it inexpedient to disturb and shall invest the produce on Government or real securities or on the security of any Corporation or Chartered Company with power from time to time to vary such securities for any other of a similar description. And I direct that during the life of my said wife my trustee or trustees shall permit her to have the use of such part of my estate as shall not yield income and to receive the income of the residue of my estate [including the profits of my business] but charged with the maintenance education and bringing up in a manner suitable to their station in life of my sons until the age of twenty one years and of my daughters until marriage. And I direct that my trustees shall from time to time at the request of my wife during her life raise and apply any part of the capital or income of my estate for the advancement of each or any of my children. And I direct that after the death of my wife my estate and effects shall be held by my trustees. In trust for all my children in such shares and proportions and in such manner in all respects as my said wife by any deed or deeds or by her last will and testament or any codicil or codicils thereto shall direct or appoint and in default of such direction or appointment. In trust for all my children equally who shall attain the age of twenty one years or marry but no child to whom an advancement shall have been made as aforesaid shall participate in the residue of my estate without bringing such advancement into distribution. And I empower my trustees after the death of my wife to apply the whole or any part of the income and any part not exceeding one half of the capital of each or any child’s presumptive portion for his or her benefit by way of maintenance advancement or otherwise and the unapplied income of any such portion shall be accumulated and the accumulations shall follow the destination of the capital whence the same shall have arisen. I declare that the receipts of my trustees for moneys paid to them by purchasers or others shall be sufficient discharges for the same and exonerate such purchasers or others from liability to see to the application thereof. I empower my trustees to compound and compromise debts and claims and settle my accounts and affairs and to submit to arbitration any dispute in relation thereto. And I direct that my trustees may deduct and mutually allow to each other all disbursements incident to the execution of the trusts of this my will and shall be responsible each for his own acts and defaults only and irresponsible for losses occurring without wilful neglect or default and shall be indemnified out of my estate against all liabilities consequential on the execution of the trusts of this my will and particularly the carrying on of my trade pursuant to the powers hereinbefore contained. I direct that vacancies in the office of trustee of my will occurring from death in my lifetime or otherwise disclaimer resignation or incapacity shall from time to time be supplied by the surviving or continuing trustee for the time being or in default of any such then by the retiring trustee or the executors or administrators of the last deceased trustee. And I declare that all the trusts and powers hereinbefore confided to my trustees herein named may be executed by the trustees or trustee for the time being of my will. I appoint the said James Sillick and James Arnott to be trustees and executors of my will and I appoint my wife and after her death the trustees or trustee for the time being of my will to be guardians or guardian of my infant children. In witness whereof I have hereunto subscribed my name this eighteenth day August in the year of our Lord one thousand eight hundred and forty seven John Featherston.

Now Know all Men by these presents That we the above named James Sillick and James Arnott for divers good causes and considerations us hereunto specially moving do hereby renounce Probate and execution of the said will and also Letters of Administration with the same annexed. And to the end that this our Prorely? Of Renunciation may have due effect in law We do hereby nominate constitute and appoint John Burrell Notary Public one of the Procurators General and Excercent of the Consistory Court of Durham to be our true and lawful Proctor for us and in our names to appear before the Right Worshipful James Baker Clerk Master of Arts Vicar General and Official Principal lawfully constituted of the Right Reverend Father in God Edward by Divine Providence Lord Bishop of Durham his surrogate or some other competent Judge in this behalf to exhibit this our Proxy? Of Renunciation and to pray and procure the same to be received admitted and enacted to all intents and purposes in Law whatsoever And generally for us and in our names and on our behalf to act and do all and singular such other acts matters and things as shall or may by law be requisite and necessary to be done in and about the Premises In witness whereof we have hereunto set our hands and seals this twenty eighth day of January in the year of our Lord one thousand eight hundred and fifty one
